Brian McCutcheonBrian McCutcheon is principally engaged in the practice of real estate and commercial law. Mr. McCutcheon has a wealth of experience in real property transactions. Mr. McCutcheon’s practice is primarily focused on representing financial institutions in connection with financing and secured transactions, including the investigation and review of due diligence materials, as well as the registration of mortgage and PPSA security. Mr. McCutcheon is also regularly retained by various financial institutions and governments in connection with the registration and perfecting of security for leasehold mortgagees.

Mr. McCutcheon has represented clients in transactions involving hotels/motels, construction loans, gas stations, large commercial office buildings and transactions of a general commercial nature, including commercial and industrial buildings, and the purchase, sale and financing of resort properties. Mr. McCutcheon’s civil engineering background has enabled him to advise clients regarding environmental issues such as underground fuel tanks and asbestos as they relate to mortgage security. Mr. McCutcheon has provided seminars to clients covering a wide range of topics including title fraud issues and privacy matters.

Mr. McCutcheon is an active member of the Canadian Bar Association and has served as an advisor to various community groups, including local and national not-for-profit and registered charitable organizations. Mr. McCutcheon has adjudicated commercial regulatory and licensing matters as a Vice-Chair of the Commercial Registration Appeal Tribunal of Ontario.

Trent Morris

Trent MorrisTrent Morris joined Himelfarb Proszanski LLP as an associate in 2009. He was called to the bar in Nova Scotia in 1992 and Ontario in 1994, having graduated from Dalhousie University. Prior to joining the firm, Trent practiced with a large national law firm practicing in the area of complex commercial litigation.

Trent has developed experience in a wide variety of litigation matters. In addition to having represented clients in class action proceedings, which have been among the largest in Canadian history, Trent has successfully argued constitutional division of powers aspects of high profile Charter of Rights cases at all level of courts in Ontario. He has represented clients in two matters of national importance before the Supreme Court of Canada and has been part of a successful trial team in a proceeding involving the validity of the patent of one of the top ten selling drugs in Canada and the world.

Trent has been a guest speaker and presenter at continuing legal education seminars, including for the Law Society of Upper Canada. Trent has also served as a volunteer as a board member for not-for profit community organizations and as a coach of youth sports teams.

Soma Ray – Ellis Soma Ray–Ellis, is a Partner and Co-Chair of the firm’s Employment and Labour Law Group. She has extensive experience in employment law and is considered a leading employment lawyer in Ontario. Her practice includes wrongful dismissal, employment contracts, human rights, and privacy law issues. Ms. Ray-Ellis has participated in many high profile litigation matters, most recently as lead counsel to Air India at the Air India Inquiry.

Ms. Ray-Ellis recently authored the Discrimination and Human Rights volume for Halsbury’s Laws of Canada, 2008, the premier encyclopedic digest on human rights law. She also co-drafted the original Human Rights Tribunal’s Rules of Practice and has published numerous texts including the Federal Equity Manual, 2002. Ms. Ray-Ellis’ vast experience has also resulted in her being appointed to the Editorial Advisory Board of Carswell’s Employment Policies that Work. She has also published numerous articles on all aspects of employment and wrongful dismissal law. In addition, Ms. Ray-Ellis has made submissions to the Joint Parliamentary Committee reviewing employment insurance rules.

Ms. Ray-Ellis has spoken at various national and international conferences, most recently in Austria, Rome, and South Africa on employment law issues. She has been quoted extensively in national newspapers, including the Globe and Mail, the Toronto Star, and the National Post and has made numerous appearances on CTV National News, CBC Newsworld, and City TV. She has also interviewed on numerous occasions on the topic of employment law and human resource issues on 680 News Radio.

For her work, Ms. Ray-Ellis has received numerous awards and distinctions, most recently being inducted into India Abroad Newspaper’s Power List in 2009. She has also been named 2008 Lawyer of the Year (Female) by SABA and has received the Business Leadership award from Women Entrepreneurs of Canada. She is noted in both Canadian Who’s Who and Who’s Who of Canadian Business. Ms. Ray-Ellis was also honoured by the American Biographical Institute, Inc., in 2005 by being named 1 of 1000 Great Women of the 21st Century.

Ms. Ray-Ellis has also contributed to the community through her various charitable works including serving on the Board of Directors of Scouts Canada and the Toronto Philharmonia. In 2009, she also chaired the Vietnamese Ball.

Leslie DizgunMr. Dizgun is an experienced advocate in corporate, commercial litigation and employment law matters. He has received his Master of Laws degree in Alternative Dispute Resolution from Osgoode Hall Law School and is co-author of a book on Mediation Advocacy: Effective Client Representation. Peter Proszanski

Peter ProszanskiPeter Proszanski, with over 20 years of practical experience,is head of the Real Estate/Corporate Commercial departments of the firm. Mr. Proszanski has a diverse institutional and entrepreneurial client base. His extensive knowledge and understanding of numerous areas of the law reflect his ability to identify and resolve difficult issues creatively and effectively. Mr. Proszanski’s past experience in real property matters includes representing lenders on all aspects of financing transactions, from perfecting security, advising clients regarding provisions of commitment letters, representing borrowers and lenders on major construction loans, to providing advice to risk departments of Schedule II Chartered Banks on their loan documentation and title insurance policy options. Mr. Proszanski has represented clients on countless purchases and sales of commercial properties, as well as participating in development related transactions. Mr. Proszanski also represents a title insurance company has provided advice to several clients who have been victims of title fraud, including highly sophisticated frauds which have the effect of changing control of property ownership without tampering with title.

Mr. Proszanski served as in-house counsel for Coca-Cola Beverages for over 4 years. While at Coca-Cola Beverages, Mr. Proszanski provided legal services at an operational level and was responsible for franchise licensing, management, leasing matters and company acquisitions, and managing outside counsel. His experience at Coca-Cola Beverages has made Mr. Proszanski cognizant of the fact that in-house counsel must constantly ensure that suppliers of legal services deliver such services on a cost effective basis.

Mr. Proszanski and the firm have encouraged its members to apply the skills learned in law to the benefit of the communities within which we live. Mr. Proszanski is actively involved in community endeavours and is a member of the Board of Directors of the Good Shepherd Ministries, an organization providing shelter and food to the homeless in the City of Toronto. Under Mr. Proszanski’s guidance, the firm has provided pro bono legal advice to many charitable institutions, such as the Myelin Project, the HOBY (a youth leadership organization), the Canadian Muslim Association, Canadian Friends of the Western Wall Heritage Foundation Inc., the Church of the Street Connection Inc. and other charitable organizations. Brady Jones

Josephine L. ComegnaBrandon (Brady) Douglas Jones currently practices in the area of real estate and wills and estates law. Mr. Jones joined the team at Himelfarb Proszanski LLP in January 2013. Monica ChakravartiMonica Chakravarti is a member of the litigation team and has extensive experience in personal injury, medical malpractice, motor vehicle accidents and insurance related claims. Monica has successfully appeared before many levels of Courts and Tribunals and represents her client with zeal and compassion. Since Monica’s call to the Bar she has practiced exclusively in litigation.

Monica is a skillful litigator whose approach focuses on obtaining results that the client needs to pursue a quality of life for themselves and their families.

Katherine A. Badenoch

Katherine graduated from Queen's University with an Honours Bachelor of Arts degree in political studies. She then attended Osgoode Hall Law School, graduating in 1999. She was admitted to the Law Society of Upper Canada in 2001.

Katherine spent much of her career specializing in litigation and insurance law, and practiced with a prominent insurance defence firm in downtown Toronto. Her practice is now focussed on all manner of personal injury cases, including complex motor vehicle and accident benefits claims, occupier's and municipal liability claims, product liability claims, and disability litigation.

Her clients benefit from the wealth of experience she gained while representing insurance companies throughout her career, and this background has provided her with a unique perspective.

Katherine has extensive experience as an advocate, including trial experience. She is a member of the Toronto Lawyers Association; the Advocates' Society; the Canadian Bar Association; and, the Ontario Bar Association.

In her spare time Katherine enjoys skiing, rowing, travelling and most of all, spending time with her family and friends.

Soma Ray – Ellis Soma Ray–Ellis, is a Partner and Chair of the firm’s Employment and Labour Law Group. She has extensive experience in employment law and is considered a leading employment lawyer in Ontario. Her practice includes wrongful dismissal, employment contracts, human rights, and privacy law issues. Ms. Ray-Ellis has participated in many high profile litigation matters, most recently as lead counsel to Air India at the Air India Inquiry.

Ms. Ray-Ellis recently authored the Discrimination and Human Rights volume for Halsbury’s Laws of Canada, 2008, the premier encyclopedic digest on human rights law. She also co-drafted the original Human Rights Tribunal’s Rules of Practice and has published numerous texts including the Federal Equity Manual, 2002. Ms. Ray-Ellis’ vast experience has also resulted in her being appointed to the Editorial Advisory Board of Carswell’s Employment Policies that Work. She has also published numerous articles on all aspects of employment and wrongful dismissal law. In addition, Ms. Ray-Ellis has made submissions to the Joint Parliamentary Committee reviewing employment insurance rules.

Ms. Ray-Ellis has spoken at various national and international conferences, most recently in Austria, Rome, and South Africa on employment law issues. She has been quoted extensively in national newspapers, including the Globe and Mail, the Toronto Star, and the National Post and has made numerous appearances on CTV National News, CBC Newsworld, and City TV. She has also interviewed on numerous occasions on the topic of employment law and human resource issues on 680 News Radio.

For her work, Ms. Ray-Ellis has received numerous awards and distinctions, most recently being inducted into India Abroad Newspaper’s Power List in 2009. She has also been named 2008 Lawyer of the Year (Female) by SABA and has received the Business Leadership award from Women Entrepreneurs of Canada. She is noted in both Canadian Who’s Who and Who’s Who of Canadian Business. Ms. Ray-Ellis was also honoured by the American Biographical Institute, Inc., in 2005 by being named 1 of 1000 Great Women of the 21st Century.

Ms. Ray-Ellis has also contributed to the community through her various charitable works including serving on the Board of Directors of Scouts Canada and the Toronto Philharmonia. In 2009, she also chaired the Viennese Ball.

Daniel Waldman

Daniel Waldman Daniel’s practice at Himelfarb Proszanski focuses on a broad range of complex commercial litigation matters, appeals and regulatory and administrative advocacy.

Daniel works hard to achieve solutions for his clients which are both practical and cost-effective. His practical approach to litigation has led to the successful resolution of many disputes as a result of negotiation and mediation. Daniel has represented clients before all levels of court in Ontario and before numerous administrative tribunals, including the Ontario Securities Commission, the Investment Industry Regulatory Organization of Canada and the Real Estate Council of Ontario.

Before joining Himelfarb Proszanski, Daniel spent over four years as a litigator at one of Canada’s largest full-service law firms. Prior to that, Daniel worked as both an articling student and as litigation counsel for the Ontario Securities Commission in the enforcement branch. During this time, he worked on a number of significant matters involving securities fraud, prospectus disclosure and other regulatory matters.
